Code of Ethical Conduct Interim Policy


Purpose/Background

As California's oldest chartered university, University of the Pacific has a long, rich history of providing superior, student-centered learning experiences. In the pursuit of maintaining and promoting Pacific's reputation for excellence and integrity, this Code of Ethical Conduct ("Code"), which sets forth the general principles and expectations to which all members of the University Community (as defined below) are expected to adhere. This Code is written to complement Pacific's values of academic excellence, diversity + inclusion, integrity + accountability, and respect + civility. This Code was developed to support compliance with federal, state, local laws, and regulations, university policies and procedures, contractual and grant obligations, professional standards, and generally accepted principles of ethical conduct.

Applicability/Responsibility

This Code applies to all members of the University Community (defined to include Regents, administrators, faculty, staff, and other individuals employed by the university using university resources or facilities, and volunteers and representatives acting as agents of the university).

The AVP for Human Resources will be responsible for the day-to-day monitoring and enforcement of ethical practices of all University of the Pacific personnel and volunteers. Monitoring and enforcement relating to actions of individual Regents shall be administered by the Board of Regents.

Policy Statement

Adherence to the Highest Ethical Standards

Every member of the University Community should conduct their activities with the highest professional and ethical standards. Members belonging to a profession governed by standards specific to the profession (e.g. attorneys, psychologists, or certified public accountants), should adhere to such professional standards as well. Similarly, students at Pacific are governed by a specific code of conduct, as outlined in Tiger Lore.

Support of the University's Goals and Avoidance of Conflicts of Interest

Every member of the University Community is expected to faithfully carry out their activities in furtherance of the University's mission. Student impact is an important consideration in every decision we make. A member may not use their position with the University for personal benefit. Every member has a duty to avoid conflict between personal interests and official responsibilities. We meet this duty by following university policy and guidelines for reporting and reviewing actual, potential and perceived conflicts of interest and conflicts of commitment [link]. We are committed to learning from and enhancing our communities and we are committed to doing this in an inclusive and ethical way.

Respect for and Compliance with the Law and University Policies

Every member of the University Community is expected to become familiar with those laws, regulations, codes, University policies, and procedures which are applicable to their position and to comply with both their letter and spirit. The university will implement programs to enhance members' awareness and to monitor and promote compliance. All members are individually accountable for their own actions, and managers and supervisors are responsible for teaching and monitoring compliance.

Respect for the Rights and Dignity of Others

Pacific is committed to policies of equitable treatment, opportunity, civility, and respect in its relationship with its faculty, administrators, staff, students and others who come into contact with the University. Every member of the University Community is prohibited from discriminating on the basis of race, color, religion, national origin, ancestry, age, genetic information, sex/gender, marital status, veteran status, sexual orientation, medical condition, pregnancy, gender identity, gender expression or mental or physical disability. Generally, Community Members are expected to practice civility and respect in line with university policy.

Maintenance of the Highest Standards of Academic Integrity

Every member of the University Community involved in learning, teaching, or research activities is expected to conform to the highest standards of honesty and integrity. Activities such as plagiarism, misrepresentation, and falsification of data are expressly prohibited. All research at the university must be conducted in strict conformity with the applicable university policies and procedures, and within the requirements of governmental and private research sponsors regulations and/or contracts.

Conducting Business Practices with Honesty and Integrity

Every member of the University Community is expected to conduct all business with patients, payers, vendors, competitors, and the academic community with honesty and integrity. This duty includes but is not limited to: adherence to federal and state anti-fraud and referral prohibitions in dealing with vendors and referral services; adherence to all antitrust laws (such as those governing prices and other sales terms and conditions, improper sharing of competitive information, and group boycotts); and protecting and preserving university property and assets including proprietary intellectual property, buildings, equipment, books, supplies and funds. Members should exercise reasonable judgement in the use of university resources, acting with care and prudence at all times, understanding that university funds derive from our students and donors, or through contracts which may direct our actions. At all times, we must act in compliance with associated laws, rules and regulations. Financial and research reports should be prepared in accordance with policy and regulatory guidelines, and reflect each transaction accurately.

Reporting Violations of the Code and Protections

Each member of the university is expected to uphold the standards of the university and all violations of the Code will be taken seriously. Members of the community are strongly encouraged to report suspected violations of the Code of any other apparent irregularity to either their supervisor, Human Resources, Internal Audit, Office of Compliance, Office of Sponsored Programs or Office of General Counsel. In addition, members can report violations anonymously to the Ombudsperson's Office or to the university's Compliance Helpline. Reports to the Compliance Helpline can be made anonymously. There will be no adverse action, retribution, or other reprisal for the good-faith reporting of a suspected violation of this Code, even if the allegations ultimately prove to be without merit. However, the university will pursue disciplinary action against any Community Member who is shown to have knowingly filed a false report with the intention to harm another.

Review and Investigation

All complaints or inquiries regarding non-compliance with this Code of Conduct will be reviewed to establish whether a university policy has been violated. The review will be conducted in conformity with the requirements of the applicable policy, or, if none is stated, an appropriate official within the university. The review shall not be conducted by a person or office that is the subject of the alleged violation.

Violations

Violations of the Code of Ethical Conduct will be addressed in accordance with the appropriate disciplinary guidance stated in the Staff handbook, the faculty handbook, and for students, Tiger Lore, and in compliance with applicable federal and state laws, rules and regulations.
